Welcome to Black Cat Artist Studio ("Company", "we", "our", "us"). By accessing or using our website and services, you agree to be bound by these Terms and Conditions. Please read them carefully.
Black Cat Artist Studio provides AI-powered digital marketing services including but not limited to: content creation, social media management, paid advertising, SEO, AI chatbot development, SaaS marketing strategy, and brand design. Specific deliverables and timelines are defined in individual client agreements.
All services are billed in USD. Monthly retainer fees are due on the same calendar date each month. One-time projects require a 50% upfront deposit with the balance due upon completion. We accept credit/debit cards, PayPal, and bank wire transfers.
Late payments beyond 7 days may result in temporary suspension of services. Accounts unpaid for 30+ days may be referred to collections. We reserve the right to update pricing with 30 days' advance notice.
New monthly retainer clients are eligible for a 7-day satisfaction guarantee — if dissatisfied within the first 7 days of service commencement, a full refund of the first month's fee will be issued. After 7 days, refunds are assessed on a case-by-case basis at our discretion.
One-time project fees are non-refundable once work has commenced. If a project is cancelled before commencement, the deposit may be fully or partially refunded depending on work already performed.
Upon full payment, all custom creative assets produced exclusively for you (content, graphics, copy) become your property. We retain the right to use anonymized campaign data and aggregate performance metrics for internal improvement and marketing purposes (e.g., stating "we helped a client achieve X% growth").
Black Cat Artist Studio retains ownership of all proprietary tools, templates, AI models, processes, and frameworks used in delivering our services.
Clients are responsible for: providing timely feedback and approvals; supplying necessary brand assets, logins, and access; ensuring their products and services comply with applicable laws; and maintaining accurate billing information. Delays caused by client inaction may affect timelines without affecting billing.
Both parties agree to maintain confidentiality of any proprietary business information shared during the engagement. This includes business strategies, financial data, customer lists, and any information marked as confidential. This obligation survives termination of services.
Black Cat Artist Studio provides marketing services but does not guarantee specific outcomes such as sales revenue, follower counts, or search rankings. Marketing results depend on numerous factors outside our control. Our total liability for any claim shall not exceed the total fees paid in the 3 months prior to the claim.
Either party may terminate monthly services with 14 days' written notice. We reserve the right to terminate services immediately in cases of payment default, breach of these terms, or conduct deemed harmful to our business or third parties.
These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes will first be attempted to be resolved through mediation. If unresolved, disputes will be submitted to binding arbitration.
We reserve the right to update these Terms at any time. Material changes will be communicated via email with 14 days' notice. Continued use of our services after such notice constitutes acceptance of the updated Terms.
