These Terms of Service ("Terms") govern your use of the Black Cat Artist Studio website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use the website.
1. About us
Black Cat Artist Studio is a creative technology studio based in Karachi, Pakistan. We provide ecommerce systems, marketplace management, digital marketing, AI automation, and web development services to clients worldwide.
2. Use of the website
By using this website, you agree that you will not:
- Attempt to gain unauthorised access to any part of the site or its systems.
- Use automated tools to scrape, copy, or harvest content or data.
- Submit false, misleading, or abusive information through our forms.
- Interfere with the operation of the site or the experience of other users.
3. Services and proposals
Information on this website is provided for general guidance only and does not constitute a binding offer. All services are delivered under a separate written proposal or statement of work agreed by both parties, which will govern scope, deliverables, timeline, and price.
4. Payment terms
Unless otherwise agreed in writing:
- Projects require a 50% deposit before work begins.
- The remaining balance is due on delivery, before final handover.
- Retainers are invoiced monthly in advance.
- Invoices are payable within 7 days unless otherwise stated.
5. Intellectual property
Upon full payment, you receive ownership of all custom code, designs, and content created specifically for your project. We retain:
- Ownership of our internal tools, libraries, and frameworks.
- The right to reference the work in our portfolio unless you request otherwise in writing.
- All rights to the design and content of this website.
6. Client responsibilities
To deliver projects effectively, we rely on timely feedback, content, and access from the client. Delays caused by the client may affect timelines and could incur additional costs. You are responsible for ensuring any content you provide does not infringe third-party rights.
7. Limitation of liability
Our services are provided on a best-efforts basis. We do not guarantee specific business outcomes such as sales, rankings, or revenue. To the maximum extent permitted by law, our total liability for any claim arising out of or related to our services is limited to the amount you paid us for the specific service in question.
8. Third-party services
We integrate with third-party platforms (Shopify, Amazon, eBay, Etsy, Daraz, Google, Meta, and others). Your use of these platforms is subject to their own terms and policies. We are not responsible for changes, outages, or decisions made by third parties that affect your business.
9. Termination
Either party may terminate an engagement in writing with reasonable notice. On termination, you are responsible for payment for all work completed to date. We will hand over all completed deliverables on receipt of final payment.
10. Confidentiality
Both parties agree to keep confidential any non-public business, technical, or financial information disclosed during an engagement. This obligation survives termination of the engagement.
11. Governing law
These Terms are governed by the laws of Pakistan. Any disputes will be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan, unless otherwise agreed in writing.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top of this page. Continued use of the website after changes constitutes acceptance of the revised Terms.
